For months, several Bank of America customers have complained about valuables missing from their safe deposit boxes. And for months, the bank has denied that any thefts which are extremely rare in the industry have occurred. But two customers have found a measure of vindication.
Mara Gudis, an elderly woman who lives in the San Fernando Valley, claimed she discovered that $175,000 in cash was missing from her box at the Century City branch, which has since closed.
Recently, however, cartier diamond bracelet, BofA settled Gudis' lawsuit. Neither side would disclose the amount Gudis received, saying the terms of the settlement were confidential. BofA, which this year began insuring contents of safe deposit boxes, faces three other suits from customers at the Century City branch, including one scheduled to go to trial in mid April. "No way I'm going to just walk away from this," said Carole Cramer of Bel Air, who claimed the loss of 15 pieces of jewelry worth more than $200,000.
John Stafford at the California Bankers Assn. says safe deposit thefts are highly unusual because of the protections in place at banks. Two keys are required to open the boxes, and visitors must sign in. Vaults are sometimes monitored by video cameras or guards.
Even so, more cases have been reported in recent years, including one last fall in Chicago where at least six customers of a downtown bank found more than $500,000 worth of jewelry and gold coins missing. "Many safe deposit robberies are apparently being perpetrated not by intruders, but by bank customers," said the Bank Security Report, an industry newsletter. Last fall, Joel Sher discovered that his Rolex watch was missing from his safe deposit box at BofA's Huntington Beach branch.
Sher said bank executives told him that his box was opened in error by a locksmith during an audit in which boxes that are not paid for may be opened. Sher said he filed a claim for more than $6,000 with the bank, only to be denied and, Sher says, given the runaround.
Last month, Sher took his case to small claims court in Westminster and prevailed. He won a judgment for $5,000 the maximum for small claims.

The happiest swinger in town
Vince Vaughn earned the best possible accolade for an actor this year. He is not the Sexiest Man Alive nor the most nominated for more serious awards, but he is the A list actor most Hollywood studios are itching to work with by dint of this particular honour. Forty next year, Vaughn is the actor most likely to give investors a rosy return on their money. Not surprisingly, then, his stock is at an all time high. The fact that he specialises in comedy, in these profoundly non comedic times, has placed him in even greater demand.
If Vaughn is making huge sums of money for financiers, he is necessarily making matching funds for himself. But you'd never guess it. Vaughn is a down home kind of East Coast guy, and by all accounts one of the good ones. He's not flashy. Not like Trent, his handsome, gangly interloper in Swingers, the film that put him and his longtime friend and collaborator Jon Favreau on the map in 1996. His clothes are casually nondescript. There's no screamingly expensive Tag or Rolex watch on his wrist. And there's nothing flashy about his attitude either.
But ask the secret of his success and he doesn't hesitate. "I think having a sense of humour always served me well. Being able to laugh at myself or situations always served me well. "
Vaughn and Favreau are friends still, as well as fellow success stories. Favreau has enjoyed huge success directing Iron Man; the sequel is forthcoming. He produced Four Christmases, the hit comedy with Reese Witherspoon; 2006's The Break Up, on which he met and started dating Jennifer Aniston (the attendant hoopla did its huge box office no harm); Fred Claus; and Made, also with Favreau. The duo wrote and star together in Couples Retreat, which sees four disparate couples, all friends, attend an exotic if unconventional extended therapy session in Bora Bora.
Vaughn is not only a master of comedy, he's a master at marketing, too. Couples Retreat is punted as a guy film, in the same way The Hangover was. But both are anti romantic comedies designed rather astutely to reel in droves of women, too. "Couples Retreat is sort of original in that it's not a romantic comedy, it really is about couples. It's about that dynamic of a group and it's about each relationship specifically, individually within that. All of us in life have different sides of ourselves. I have sides of all of the characters inside of myself as well, so I think it's relatable. We know these people with these problems and it's a comic look at that."
No one sounds more than surprised than Vaughn that he has made his name at the movies making people laugh about relationships. While admitting he is something of a scholar on the subject, he claims no particular expertise.
"The only expert thing I know about a relationship is that I don't know anything. I think every time I think I know something, obviously you then learn that you don't know anything, but I do know this to be true: I know that men marry women hoping that they will not change, and women marry men hoping that they will change, cartier love braclet replica, and inevitably, everyone's disappointed. "
Instead, he says he's an observer who likes to remain unobserved whenever possible, which, at 6ft 4",cartier bracelet replica, can't always be easy. "I'm no different than your neighbours or your friends. I just have an ear to hear. I can watch a couple having dinner and tell if it's a new relationship or an old one. I'm interested in human beings, so I listen. "
There was talk while Vaughn was dating Aniston that he was uncomfortable with being forced into the media spotlight because of her strangely ineffable celebrity. At the time, though, he talked charitably of those whose flash glare he often intercepted. "I realise the paparazzi are just doing their jobs. It comes with the territory and I laugh at it. I find it all a bit silly."
But it was clearly not what he signed up for. Vaughn grew up just outside Chicago with two older sisters (all the siblings' names begin with V), his meat company sales manager father and a Canadian mother, Sharon, who was formerly a stockbroker ranked one of America's top money managers. Though she now works as an estate agent, Sharon has presumably perused her son's robust bank statements of late and offered her best advice. Vaughn's eldest sister, Victoria, now works alongside him as a producer.
Vaughn excelled at American football and wrestling, and dreamed of sporting glory until he was injured in a car crash, which put paid to his sporting future. He moved to Hollywood in 1988 but didn't secure his first film job until Rudy in 1983,love bracelet cartier diamonds, a film set against an American football backdrop and co starring Jon Favreau. Favreau subsequently wrote the role of Swingers' Trent for his friend. It changed both their lives.
"All I ever wanted was to become an actor," he says. " I was so happy to get a line on a television show, or get a television commercial. I never had a game plan of celebrity or being famous."
Vaughn has apparently maintained his focus in work and outside it. He is engaged to Kyla Weber, a Canadian estate agent. His friends are reportedly happy he has found himself a nice "civilian". How did they meet? He laughs like he can't quite believe it. "At a wedding." It's not just a clich for Vaughn. One of his biggest successes was The Wedding Crashers in 2005,cartier love bracelet bangle, then one of the most successful comedies ever.
Previously, it was 2003's Old School, that put Vaughn on all the right maps. Until then, he had vacillated between comedy and drama and proved himself adept at the latter. Swingers led to a showy turn in The Lost World, the sequel to Jurassic Park, Steven Spielberg having apparently been a Swingers fan. Vaughn then beat a slew of bigger Hollywood names to play Norman Bates in the much vaunted, little seen remake of Psycho. No one pinned its failure on Vaughn. At about the same time, he was racking up good reviews for the dramas Clay Pigeons and Return to Paradise. He shone in the lacklustre Domestic Disturbance alongside John Travolta in 2001 but has since made a sharp departure from drama. He likes to stay in practice, though, which is why he starred in 2007's searing Into the Wild.
But drama is not what makes Vaughn happy. "I think there's room for everything but I like stuff that's exaggerated for comedy. I love the scene in Swingers when Trent calls this girl five times and finally leaves this message. It's funny but it's also really painful."
Vaughn's a realist, after all, though he has not yet arranged that wedding date. "I'm not nervous about the big day because I haven't planned a big day." Yet he sounds quietly confident about Weber's being The One.
Having fathered a slew of enormous film productions, I ask if it's a coincidence that one of his upcoming projects is called Male Doula . "I guess not." Is the film helping him prepare for fatherhood? "I don't know. It's really scary until they can talk because you don't know what they want. But I'm sure I'll be very happy."

Apple's iOS 7 already saw the introduction of Activation Lock, which was built to prevent stolen phones from being wiped, unlocked, sold elsewhere, and activated by a buyer who wasn't aware of the phone's illicit journey. But phone manufacturers are looking to take things a step further, and for good reason. Phone theft has become quite the problem in major cities, where these $800 devices are easily taken and then hawked online, often to buyers in foreign locales. To combat the surge of phone theft, Apple, AT Google, Verizon Wireless, and Samsung have all said that they'll offer free antitheft.

The impact of piracy on the music business has been studied in detail, but the relationship between illegal downloads and film revenue hasn't been explored to nearly the same degree. The results of the study are being somewhat erroneously reported as "Piracy doesn't hurt the movie industry" but the truth is rather more nuanced. What the researchers found was that in the US, the drop off in movie.
And now, a message from the "Seriously, don't do this" department.

In the latest example of crime not paying, a former Intel employee named Biswamohan Pani pleaded guilty this week on five charges of fraud stemming from his theft of hundreds of millions of dollars worth of design documents from the chipmaker. According to Bloomberg, Pani gave Intel his two weeks notice on May 29, 2008, and he retained his employee access to Intel data until June 11; however, he started at AMD on June 2. The impact of piracy on the music business has been studied in detail, but the relationship between illegal downloads and film revenue hasn't been explored to nearly the same degree. A new study from researchers at the University of Michigan and Wellesely College has examined the impact of BitTorrent on domestic and foreign ticket sales and come back with some interesting conclusions. The results of the study are being somewhat erroneously reported as "Piracy doesn't hurt the movie industry" but the truth is rather more nuanced. What the researchers found was that in the US, the drop off in movie.
And now, a message from the "Seriously, don't do this" department. Four Taiwanese engineers working for various Intel OEMs were arrested this week by China's Criminal Investigation Bureau for selling so called "Engineering Samples" (ES) chips on Ebay and pocketing the proceeds. The police recovered 178 CPUs with an estimated worth of $82,590; the group has admitted to selling over 500 chips since 2009. ES chips are often popular among overclockers for their rumored ability to hit higher clock speeds. Ironically, this is decidedly hit and miss. Intel regularly ships ES processors out to reviewers,.

CLEVELAND, Ohio Cuyahoga County Commissioner Jimmy Dimora parlayed his job as a public servant into a private life of entitlement, prosecutors say.
The charges portray the commissioner in a poor light: He had sex with prostitutes, paid for by other people; he had sex with a woman who sought his help finding a job. He received free kitchen appliances from people seeking jobs and contracts. He gambled on trips paid for by multimillion dollar businesses needing his help.
An indictment unsealed Wednesday offers a portrait of a man with insatiable greed. As Cuyahoga County sank to the bottom of the poorest metro regions in the country, Dimora enriched himself on the backs of taxpayers, prosecutors say.
He got free limo rides for his family, talk of a job for his retirement, an Ohio State football jersey and a new roof over his patio, the indictment says. Over and over, people who wanted his favors paid for his world, according to the charges.
Catherine Turcer of Ohio Citizen Action, a public watchdog group, blasted Dimora for serving the public with his hand out.
"Who would even think to do this sort of stuff?" she said. "We're talking about a county that is very poor and cannot be taken advantage of."
In court Wednesday, Dimora denied the charges. He appeared adamant that he would fight them.
The indictment suggests that when some contractors went to Dimora for help, he was clear that he wanted something in return.
Consider these scenarios described in the indictment:
Ferris Kleem, a construction contractor, sought tens of millions of dollars in contracts from the county from 2006 through 2008. In exchange, he gave Dimora a refrigerator, a trip to Las Vegas with $5,replica rolex gold oyster perpetual datejust,000 in cash to gamble and $1,000 for first class airfare, the services of a call girl, limousine service in Las Vegas and discounts on a television and a Rolex watch.
A woman looking for Dimora's help in landing a $40,000 a year job in 2008 had sex with him, prosecutors say. In one instance, Dimora sought out a friend to rent a room for a tryst with the woman because he didn't want to be noticed by anyone.
Kevin Payne, a county engineer's employee, provided Dimora with prostitutes, replica rolex mens oyster perpetual datejust, a condominium suite for personal use including a "Saturday night adventure" and limousine service for Dimora's family, according to prosecutors. In exchange, Payne wanted Dimora's help in the relocation of the engineer's office in 2003 and other office issues. "I appreciate your, uh, due diligence on this for me," Dimora told Payne on April 5, 2008, according to the charges. "Thank you. You're a good man. Thank you." Payne has left the office.
The chief executive officer of a business seeking Dimora's assistance on contracts helped Dimora look like a charitable citizen at a Cornerstone of Hope fundraiser in 2008, the indictment says. The CEO provided the $3,600 that Dimora used to buy a framed jersey of former Ohio State University running back Chris "Beanie" Wells. The contractor also provided free and discounted work done on Dimora's home in the fall of 2007, according to the charges.
Contractor Steven Pumper, the former CEO of D A S Construction, gave Dimora $33,000 in cash, Cavs and Indians tickets and tens of thousands of dollars in free and discounted work at his home, including a grill area for his patio, a barbecue shelter, patio floor and a patio roof. In exchange, replica ladies rolex oyster perpetual datejust, Dimora helped Pumper gain contracts and talked to a judge to help Pumper in a lawsuit, prosecutors allege.
Pumper also talked with Dimora about a retirement job with Green Source Products, a company linked to Pumper's family that specialized in green building techniques. Pumper pleaded guilty to bribery charges last year.
Real estate appraiser and Dimora friend Jerry Skuhrovec offered the commissioner a 3 gallon bucket of ice cream. Dimora said he would put it in his freezer with the other "donations," according to the charges. It is unclear from the charges what Dimora meant by those donations. Skuhrovec, replica old rolex oyster perpetual datejust, who had been seeking an appraiser's job with the county, also paid for other gifts and did favors for the commissioner, according to the charges. "More than food, Jer," Dimora said, according to the charges. "But I'll explain that to you when we're not on the phone.".

Corruption as 'Ordinary Politics'
Supreme Court will take up ex Virginia Governor Bob McDonnell appeal of his 11 count corruption conviction stemming from his relationship with a wealthy businessman, Jonnie Williams. McDonnell trial made headlines back in 2014, but in this off the wall election year his Supreme Court appeal has mostly flown under the radar. That a shame, because in many respects the case is a window into why American democracy is where it is today.
McDonnell was Virginia governor from 2010 to 2014. While in office, he cultivated a relationship with Williams, the CEO of a company called Star Scientific. Star produced a dietary supplement called Anatabloc that it wanted the FDA to classify as a drug (allowing it to charge much more per dose). Obtaining such a classification requires expensive clinical trials to show that the purported drug actually has some medical benefit. Rather than have Star spend millions to do those trials, Williams hoped the state would do the research at one of its universities.
McDonnell and his wife Maureen were enthusiastic boosters of this scheme. They hosted the Anatabloc product launch at the governor mansion and repeatedly pressured senior officials to arrange meetings between state researchers and Star employees. In one memorable scene, McDonnell literally pulled a bottle of Anatabloc out of his pocket and pitched it on the spot to officials in charge of the state health plan.
Such high level salesmanship doesn come cheap. At trial it emerged that Williams had given the McDonnell family more than $175,000 in expensive gifts and cash, including luxury vacations and golf outings, a shopping spree at Bergdorf Goodman for Maureen, a Rolex watch for Bob, and help with paying for the weddings of both McDonnell daughters. The transactional nature of these gifts was perfectly clear. At one point Maureen McDonnell literally said to Williams: governor says it okay for me to help you . . . but I need you to help me. forward to today. What is remarkable about McDonnell case is not the technical arguments he makes, but the sheer brazenness with which he and many his supporters defend his conduct. McDonnell cert. petition asserts that his dealings with Williams were nothing more than politics, akin to attending a coffee event with supporters or a trade association roundtable. attorneys general analogizes the largesse McDonnell received from Williams to the lunch a politician might consume at a speaking engagement. Another piously intones that affirming his conviction will the air of liberty and undermine our democracy. Most of these submissions are unwilling to concede that McDonnell behavior was at all morally problematic, let alone reprehensible. The picture they paint of public service in America borders on the surreal.
Some of the blame for this situation surely lies with the Court itself. The vision of democracy on which McDonnell and his supporters lean is rooted partly in cases like Citizens United and McCutcheon, where five members of the Court appeared at least to many observers to embrace the idea that there is a constitutional right to use large campaign contributions and expenditures to buy influence over those in power. While there are good reasons to think McDonnell actions were beyond the pale even for this Court, you can entirely fault him for trying.
The fact that such a broad swathe of the elite seem to have bought into such arguments is striking, replica rolex oyster datejust perpetual, however. Many of these same people are no doubt horrified by the tenor of this year presidential election. They may worry with justification that a campaign animated by little more than raw disgust at the political system is unlikely to lay the groundwork for an effective governing agenda. And they may also be deeply troubled by the fact that the public trust in all institutions of government continues to hover at or near record lows. Yet they and many other members of the political establishment remain curiously unreflective about how we got to this point.
The truth is that McDonnell case is not an easy one even for many committed advocates of political reform. One can wholeheartedly reject the suggestion that his actions were nothing more than politics entitled to First Amendment protection, while still being uneasy about use of the heavy hammer of criminal bribery laws to police norms of official conduct. Arguably everyone involved in this case (including the McDonnells) would have been better served by a system of clear, bright line limits on both campaign contributions and personal gifts to elected officials and their families.
At the end of the day, replica ladies rolex datejust, though, rolex watch oyster perpetual datejust replica, those safeguards only work if the broader political culture accepts their legitimacy. Jurors in McDonnell trial to resume deliberations Wednesday
RICHMOND, Va. (AP/WAVY) The corruption case that could send former Virginia Gov. Bob McDonnell and his wife to federal prison was in the hands Tuesday of jurors who must decide whether the couple sold the influence of the office to a wealthy vitamin executive seeking legitimacy for his company signature product. District Judge James S. Spencer spent nearly two hours reading instructions to jurors before they filed out of the courtroom to decide the fate of a onetime rising Republican star who was widely considered a potential running mate for presidential candidate Mitt Romney in 2012, just before the scandal broke.
Bob and Maureen McDonnell are charged in a 14 count federal indictment with accepting more than $165,000 in gifts, trips and loan from Jonnie Williams, former CEO of dietary supplements maker Star Scientific Inc., in exchange for special favors.
The seven man, five woman jury heard from dozens of witnesses and reviewed a mountain of exhibits over the past five weeks.
College of William and Mary law professor Jeff Bellin said the case will come down to whether jurors believe McDonnell and Williams had some kind of agreement to exchange money for official acts.
key to the case was what they thought was in Bob McDonnell mind when he was getting this money from Jonnie Williams, he said.
Williams, fake rolex oyster perpetual datejust stainless steel, the prosecution star witness, testified under immunity that he spent lavishly on the McDonnells only to secure their help promoting and obtaining state backed research for Star tobacco derived anti inflammatory, Anatabloc.
Bob McDonnell testified he did nothing other than extend routine political courtesies to Williams. MaureenMcDonnell did not testify.
Williams immunity deal bars his prosecution not only for his dealings with the McDonnells, but also for possible securities fraud violations that were investigated by a separate grand jury.
McDonnell attorney, Henry Asbill, said in closing arguments Friday that the unusually generous immunity deal was Williams con. Prosecutor Michael Dry countered that because of the agreement, Williams had no reason to lie on the witness stand.
Spencer told the jury that the testimony of a witness who is granted immunity must be more closely examined than testimony of other witnesses. The heightened scrutiny is required to determine whether the testimony of the immunized witness is by self interest, he said.
He also told the jury they should not make any inference from the fact that a defendant did not testify Maureen McDonnell declined to testify throughout the trial.
The judge also walked the jury through the charges, including services fraud and conspiracy to commit such an offense.
conspiracy is, in a very true sense, a partnership in crime, Spencer said.
To be found guilty, he said, a defendant must understand the nature of the conspiracy and deliberately join it.
However, he said a conspiracy does not have to achieve its goals an instruction that could undercut a defense claim that Williams never received anything of substance, including the research he took preliminary steps to seek.
He also said a corrupt agreement need not be stated explicitly by the conspirators and that it doesn matter whether the defendant would have done favors absent a bribe.
Spencer also told jurors who heard from three character witnesses, two for Bob McDonnell and one for his wife that of good character alone may create a reasonable doubt as to a defendant guilt. defense argued that the McDonnells marriage was in such shambles that the couple could not have conspired because they were barely speaking. Maureen McDonnell attorney said the first lady developed a on Williams, who capitalized on her vulnerability and further poisoned her marriage.
Williams bought nearly $20,000 in designer clothes for Maureen McDonnell and a $6,500 Rolex watch that she gave Bob McDonnell for Christmas. He also gave $15,000 for a McDonnell daughter wedding reception and treated the McDonnells to trips and golf outings. Williams issued three loans totaling $120,000.
