«Взяли первые две десятки обмена биткоина на «Сбер» (об этом говорят реферальные ссылки, фигурирующие в самих решениях) и по каждому прокурор подал самостоятельный административный иск».
В 2019 году Роскомнадзор, руководствуясь решением Куйбышевского районного суда Омска, внес агрегатор Bestchange.ru в реестр запрещенных сайтов и заблокировал к нему доступ. Позже суд вынес решение о снятии блокировки.
Впоследствии Роскомнадзор в очередной раз заблокировал домен Bestchange.ru по решению Котласского городского суда. В ноябре Архангельский областной суд отменил решение первой инстанции о блокировке сайта, а позже Bestchange.ru удалили из реестра запрещенных сайтов.
Текущие решения отличаются от предыдущих постановлений о блокировках биткоин-обменников. Помимо «весьма пространного довода» о запрете использования денежных суррогатов, теперь присутствует и аргументация о якобы установленном нарушении закона №115-ФЗ, говорит Дарбинян:
«Хотя, уверен, по факту прокуроры не проверяли, какие инструменты KYC/AML срабатывают при попытке обменять 600 000 рублей. Никаких дел по «антиотмывочному закону» также не возбуждалось».
Также во всех постановлениях содержится утверждение, что действующим законодательством установлен запрет на получение средств путем обналичивания их с использованием иностранных платежных систем.
«Хотел бы я узнать у прокурора, к какому иностранному государству относится, например, Ethereum, и на каком основании он решил, что в сделках присутствовала иностранная платежная система？», — отметил эксперт.
Несмотря на то, что в решениях судов есть конкретный url, что делает блокировку постраничной, незаконной признана сама страница с заявкой на обмен. Без нее обменники «просто не смогут существовать», поэтому удаление конкретной страницы не решает проблему с Роскомнадзором без полной отмены решений, подчеркнул Дарбинян.
«Судя по всему, прокуроры никак не хотят принимать реальность того, что закон о цифровых активах уже принят и законодатель не пошел по пути полного запрета криптовалют, а лишь ограничил возможности ее использования и гражданско-правового оборота», — подытожил эксперт.
В настоящее время юристы готовят жалобы и будут добиваться полной отмены решений.

Risk
How much of your capital are you happy to lose if the trade goes against you - this is important to get right as it will dictate how much risk you are putting up vs the potential profit that you are looking at making. Risk vs Reward is paramount to successful trading - taking trades that have a low RvR (sub 1:2) will inevitably see you rip up your account the majority of the time
Capital Management
How much of your overall account will you put into a trade？ If its over 10% chances are its too high. Trading is a long-game and not for those seeking quick and easy profits.
Exit
This is probably the most important component - as you need to have set when you will exit a trade before you have even taken it. This may seem backward but it is probably the biggest mistake most amature traders make. By setting your exit both if the trade goes in your favor or against it sets your risk, and ensures that you will take profit without getting greedy, potentially turning a winning position into a losing one - which honestly is the most frustrating thing to deal with as a trader.
