Speaking from the western Pennsylvania prison where he is serving a 30- to 60-year sentence, Sandusky described how he retired from Penn State in mid-1999 to take advantage of an early retirement incentive, and then was immediately rehired on a temporary basis to coach one last season. A hearing examiner is taking evidence about the post-retirement benefits Sandusky received and the universitys connection to The Second Mile charity as part of Sanduskys appeal of the pension forfeiture. Sandusky said that after the 1999 season, he never received another paycheque or W-2 tax form from Penn State, never held himself out to be a Penn State employee and was even given a retirement party. At issue is whether he could be considered a school employee about a decade later, when he committed sex crimes against two boys that meet the states standards for forfeiture. Sandusky disputed documents that claim he received dozens of payments from Penn State after 1999. "I dont know the exact number for sure, but I know it was in the neighbourhood of three," he said. "It was far from 71." Sandusky was the only witness called by his lawyers, and the afternoon session began with a retirement system employee reading a timeline that outlined the former coachs history with the pension agency, starting when he was hired by Penn State in 1969. He lost a $4,900-a-month pension in October 2012, the day he was sentenced for 45 counts of child sexual abuse. The decision also precluded his wife, Dottie Sandusky, from collecting benefits. She attended the hearing Tuesday in Harrisburg. The State Employees Retirement System (SERS) ruled that his convictions for involuntary deviate sexual intercourse and indecent assault fell under Pennsylvanias Public Employee Pension Forfeiture Act. Sandusky had opted to participate in the state-sponsored retirement system while at Penn State, which is a "state-related" university, but he was not a state employee. At the heart of the dispute is whether Sanduskys ties to the university after his retirement, including some payments, made him a "de facto" Penn State employee while committing the crimes in question. His lawyer has argued he was not and that his employment contract was not renewed after the forfeiture law took effect in 1978 so its terms do not apply to him. Sandusky attorney Charles Benjamin has said Penn State made only six payments to Sandusky between 2000 and 2008, and three of them involved travel costs. The other three were speaking fees of $100, $300 and $1,500. In a Dec. 9 filing, Benjamin also argued that Sandusky did not fit the definition of "school employee" under the forfeiture law. "No reported case in the history of Pennsylvania jurisprudence has ever applied a de facto employee analysis to deny someone his retirement earnings, and SERS should not bow to political pressure and mob rule to deny claimant his retirement earnings," Benjamin wrote. In recent weeks, there was a dispute over the SERS witness list, which included two former Penn State administrators facing alllegations of a criminal coverup about Sandusky, former athletic director Tim Curley and former vice-president Gary Schultz. Leete said breach of contract claims, however, cannot continue without Penn States participation because the school is an "indispensable party," given that the lawsuit could affect the universitys interests and contractual rights. The lawsuit seeks to void a consent decree between the NCAA and Penn State over handling of the Jerry Sandusky child sex abuse scandal, an agreement that imposed a $60 million fine, a four-year ban on post-season play, a reduction in scholarships and other penalties. "If the consent decree is declared void, as plaintiffs request, Penn State would lose the benefits it bargained for, including avoiding harsher sanctions and limiting further loss that could result from a prolonged investigation," Leete wrote. He added that the NCAA had indicated earlier that the football program could be shut down if the decree was invalidated. Paterno family attorney Wick Sollers said the decision allows the critical claims in the lawsuit to go forward. The ruling will let "the bright light of legal discovery" shine on the facts and records, he said. Paterno died in 2012, weeks after the scandal erupted and he was fired as football coach. A Penn State spokesman declined to comment. "We are exceedingly pleased that the court rejected the plaintiffs effort to undo the consent decree," NCAA chief legal officer Donald Remy said in a statement. "As this was the last remaining legal challenge to the validity of the consent decree, we hope the courts decision finally brings closure to this issue and allows the Penn State community to continue to move forward under the consent decree and the athletic integrity agreement." The judge threw out a claim of interference with contractual relations but kept in place civil conspiracy and commercial disparagement elements. "Plaintiffs identified disparaging statements accusing Joe Paterno of enabling and concealing child sexual abuse and knowledge or reckless disregard with respect to their falsity," Leete wrote. He said that although the family did not meet a legal standard generally required in disparagement claims, the requirement is lifted when the disparaging statements are libelous. Leete also tossed parts of the defamation allegations, except as they apply to university trustee Alvin Clemens and two former coaches who sued, William Kenney and Jay Paterno, Joe Paternos son. After making a huge off-season splash, Toronto FC prepares to start their eighth MLS season still looking for a first ever playoff berth. Ian Desmond Jersey . TSN soccer analyst Gareth Wheeler tells you everything you need to know about Toronto FC heading into 2014, while TSN soccer analyst Jason deVos tells you how they will succeed or fail during the new campaign. Gareth Wheeler: With great signings come great expectations. Toronto FC went from afterthought to main focus in an off-season of change. President and CEO of Maple Leafs Sports and Entertainment Tim Leiweke promised big things; a swift turn around in fortunes upon his arrival. Momentum has shifted from a lifeless entity into a resurrected being with true hope and an ambitious future; no easy task for the most futile franchise in Major League Soccer history. Seven years outside of the playoffs has taken its toll. Amidst the newfound excitement is an element of prove it to me. Big promises have been made before. The shock of what has transpired with upwards of $100 million worth of transfer and payroll commitments hasnt sunk in with most. Tim-squared, as in Leiweke and General Manager Tim Bezbatchenko backed up their lofty words with decisive, calculated action. On paper, this looks to be the best Toronto FC side the city has ever seen. Now comes the hard part: sustained stability and on-field success. Neither are guaranteed, but the blueprint reads much clearer. The buzz is palpable across Toronto. The question most often asked from passionate or casual supporters alike, how good will this team be? Theres no straight-forward answer. Its easy to get swept up in the hoopla. Tickets have been sold and the team will be playing in front of a packed house at BMO Field once again. Theres a lot to be excited about and failing to make the playoffs for an eighth consecutive year would be seen as nothing short of a complete failure. Championship calibre talk however is premature. Striker Jermain Defoe and influential central midfielder Michael Bradley represent the two biggest moves of MLS off-season. With name comes substance, with Defoe and Bradley easily becoming the best two players in franchise history. They are that good and make TFCs roster comparable to top teams in MLS. Brazilian duo, goalkeeper Julio Cesar and promising striker Gilberto are a step lower on the wow scale, but entirely intriguing. Manager Ryan Nelsen has raved about Gilberto and believes the 24-year old can score more goals than prized acquisition Defoe. The return of Dwayne De Rosario represents a chance to rectify the wrong surrounding his previous hasty departure. The club at the time painted De Rosario as the bad guy disingenuously. Bezbatchenko has made clear this is a new TFC, set on doing business a different and better way. Extending the olive branch to the hometown boy made too much sense. Attempting to forecast how this team will do is fruitless. A MLS season is a marathon to begin with, never mind the added wrinkle of this summers World Cup. Notwithstanding injuries and/or factors out of the realm of control, here are three keys to success for Toronto FC in 2014. 1) Goal scoring: Bezbatchenko has said to anyone who will listen; his first job was to find TFC goal scorers. Sounds simplistic but only one team scored fewer goals than TFC last season. Toronto has been in the bottom five in goals scored in each of the last four years. The lack of a true finisher outside of the oft-injured Danny Koevermans was an indictment on team management. Without top goal scorers there is next to no chance of competing with the top sides and having regular success. It has been one of the many reasons for perennial failure to date. How many goals Defoe, Gilberto, and De Rosario will score will determine how far this team will go. Gilberto has already set a lofty, most likely unattainable goal of 25 tallies this season. Defoe should have little trouble adapting to MLS life, and 20 goals isnt out of the question. TFC lost back-up strike option Bright Dike through pre-season injury, Dike would have played a key role. Bezbatchenko would be prudent to bring in another goal scorer to compliment the bunch because you can never have enough goals in the team. 2) Back four: Cheap goals conceded have plagued TFC in recent seasons. The group last year was far too young, inexperienced and mistake prone. The group worked hard, but lacked cohesion and didnt do anything particular well. Justin Morrow and Bradley Orr were brought in to add experience to the back-line. The strength, or lack thereof, of this young group will make or break this team. Cesar as a leader at the back helps, as does Steven Caldwell as a steady, vocal force. Can Nelsen get this group playing as a unit? Does TFC have enough quality depth? And can young Canadians Doneil Henry and Ashton Morgan makes strides, finding consistency in their game? If the answer to these questions is yes, TFC will be in good stead. Age is no longer an excuse. 3) Team tactics: Nelsens first year as manager was a trying one. With very little talent, depth and a revolving door, six wins and the third worst points total in the league (29) was a predictable outcome. Evaluation of Nelsen as team manager is thus far incomplete. It surprised some Nelsen remained in the off-season of top-to-bottom change. And because of that, he remains the easy fall-guy in case all doesnt go according to plan. Another coaching change is the last thing this team needs - eight coaches in eight years speaks to the lack of vision or consistent direction. Players, no matter how good, cannot achieve in a current state of flux. It must be said the work-rate of the team under Nelsen was superior. Theres no question hes a natural leader and a well-liked figure. His man-management and tactical approach will be tested now he has better players and a year under his belt. The team generally lined up in a 4-4-2 last year. A level of formational flexibility will be required to get the most out of his assets, particularly finding the best spots to play De Rosario and Gilberto as dynamic attacking players. The hype is back at Toronto FC. Its been called A Bloody Big Deal. The only way that manifests is if the wins follow. For the first time ever at TFC, there is good reason to believe it actually will. TFC have made the single biggest offseason spending splurge in the history of Major League Soccer. Nearly $100m has been spent to acquire the likes of Jermain Defoe, Michael Bradley, Gilberto, Júlio César and Dwayne De Rosario, and the burning question is this: Will this make TFC a contender? On paper, the answer is yes. Toronto is significantly stronger now than it has ever been. They have the U.S. national teams best midfielder in Bradley, a top-class goal scorer in Defoe and Brazils number one goalkeeper in Júlio César. You wont find a stronger spine to a team in MLS. If those players live up to their reputations, Toronto FC will not only make the playoffs, they will be the team that everyone wants to avoid in the post-season. Toronto FC will fail if… ….they put the cart before the horse. Having better players is one thing; getting them to play together, as a team, is another. It will take time for TFCs crop of new players to gel, and until that happens, the microscope will be firmly focused on head coach, Ryan Nelsen. The jury is still out on Nelsens ability - as a second-year coach - to get the best out of the talented players he now has at his disposal. He tends to stick to his preferred formation (1-4-4-2), and has so far shown little interest in experimenting with various tactical approaches to the game. This can work if the players are all on board (Real Salt Lake is a good example), but only time will tell if this will be the case for Toronto FC. If the team struggles out of the gate, expect Nelsen to come under increasing pressure. 2013 finish: 6-17-11 (ninth in Eastern Conference). Did not qualify for MLS Cup playoffs. "He told me a game plan before the game and we were able to execute it," Whitley said. "Just follow whatever he has in store because that guy has everything. He does." Brian Roberts also drove in a run for the Yankees, who finally gave their young right-hander some support. Whitley (1-0) had allowed five earned runs in his first four starts, and left two of them with the lead, only for his team to saddle him with a series of no-decisions. Of course, McCann helped take care of that with his bases-loaded double. "Thats a huge hit," Yankees manager Joe Girardi said. "Its a tough at-bat. He fouls off a lot of tough pitches, a change-up, a curveball, a real slow curveball, and he got a ball up in the zone and it turned into a double." Dellin Betances worked around a double by Alcides Escobar in the eighth, and David Robertson retired Salvador Perez with runners on first and second in the ninth to earn his 14th save. The league and stadium officials decided to use a winter storm that dumped a foot or more of snow in the New York City metropolitan area Tuesday as somewhat of a dress rehearsal to see how quickly they could clean the 80,000-seat facility that will hold the first outdoor Super Bowl in cold weather. NFL executive vice-president Eric Grubman said Wednesday an 18-hour time limit was set for removing the snow from the stadium, surrounding parking lots and access roads in the Meadowlands sports complex, where the game will be played Feb. 2. Grubman refused to speculate whether the storm that snarled roads, closed schools and had states of emergency in New Jersey, New York City and some surrounding areas would have caused the Super Bowl to be postponed. He said that would be a decision made by state authorities. Grubman, however, said the league has several contingency plans for the game, including moving it up to Friday or Saturday, pushing it back to Monday or adjusting the scheduled start on Sunday deal with the weather. The game is scheduled to start at 6:25 p.m. EST. "Based on the long-range forecast, all that I would even hazard to guess is that it is probably going to be cold. I doubt we are going to have an unusual warm spell," Grubman said at the news conference originally called to showcase how the stadium was preparing for the Super Bowl. The snowstorm on Tuesday was a fortuitous coincidence for the cold-weather Super Bowl. MetLife spokeswoman Nicole Fountain said the stadium and its contractors had 1,300 workers removing the 13 inches of snow that fell in and around the stadium. The crews started removal at around 8 a.m. and had sections of the stadium and most of the tarp-covered field cleared by noon. During this past season, the crews removed six inches of wet, iced-packed snow in roughly 12 hours before a Seahawks-Giants game on Dec. 15, Ron VanDeVeen, the stadiums senior vice-president of events said Wednesday. The snow being removed Wednesday was not as heavy, he said. Grubman said the league is prepared to play the game even if there is still some snow in the stands. "Games are played with snow all the time," he said. "Its not just MetLife Stadium. I think the crowd will be an exceptional crowd and they will enjoy the game. I dont think they will be fazed by a little bit of snow on their seats, if thats what comes to pass. We aim to not have that happen, but if it happens, its sort of what happens in NFL stadiums all the time." Grubman also displayed warm welcome kits that fans will receive entering the stadium on game day. Cushions hold the kit items which included ear and hand muffs, mittens, a hat, neck warmers, lip balm and other items. "The warm welcome kit was designed to make fans comfortable," he said, "and to have those last-minute items that they may not think about." Grubman also advised fans to dress in layers for the game. He said there will be warming areas in the stadium should anyone need them. The storm that hit the area Tuesday stretched from Kentucky to New England. "If you are going to have one, and you are going to have it 10 days out, were going to make use of it," Grubman said of the storm. "The silver lining is we are running ourselves through a rigorous dress rehearsal." Grubman said the league was gathering information from law enforcement authorities about how the emergency conditions might have affected the game had it been played Tuesday. The two groups will go over the information soon. Whatever happens, the league is ready to deal with all scenarios, Grubman said. "Some people will say perfection will be a nice little dusting of snow in the third quarter," Grubman said. "Other people will say perfection will be 40 degrees in early February with the sun shining until sundown at 5:35 or 5:45 or 6:20 on Sunday, the second. "I think it is really up to the individual." The Canucks will be without their leading goal scorer for the rest of their road trip, one that resumes on Friday night against the Washington Capitals. Wednesday should have been a night that left the Canucks feeling good about themselves. They snapped a seven-game road losing streak with a 3-2 shootout win over the Winnipeg Jets in the opener of a four-game swing and saw forward Alexandre Burrows net his first two goals of the season. Of course, the good came with the bad as Ryan Kesler left in the game following a knee-on-knee collision and went back to Vancouver for further tests. It is not known how long he will be out, but head coach John Tortorella did admit that Kesler will not play for the rest of this trip, one that includes games versus the Florida Panthers and Tampa Bay Lightning. Kesler was mentioned in a number of trade rumors before last weeks deadline, but the Canucks did not pull the trigger on a deal to move the forward, who has 22 goals on the season. Keslers 40 points are tied with Daniel Sedin, currently out with a strained left hamstring, and one back of Henrik Sedin for the team lead. Minus the forward, Eddie Lack made 32 saves through overtime before stopping all three skaters he faced in the shootout. Vancouver then earned the extra point on Chris Higgins third-round tally. "We lose (Kesler) before the third and we get down, so yeah, I thought we played hard right on through.
