The Dallas-based Fifth Court of Appeals temporarily halted the case at Armstrongs request in March, but ruled on Thursday it doesnt have jurisdiction at this stage of an arbitration matter. A spokesman for SCA Promotions said the ruling will allow the arbitration to proceed. The ruling was a defeat for Armstrong but not a final one. State law will allow him to appeal any final judgment if the panel rules against him. SCA Promotions wants to reopen a 2006 settlement it paid to Armstrong, and sued the cyclist after his 2013 admission to doping during his career to win the Tour de France. The arbitration panel that first approved the settlement agreed to reconsider the case, prompting Armstrong to ask the state courts to intervene. Armstrong attorney Tim Herman did not immediately respond to a request for comment on Thursdays ruling. SCA and Armstrong have been battling since 2005, when the company first tried to withhold the bonus money and sought to prove he doped. But Guay said he battled knee issues in Russia. "I have a hard time skiing through pain, I have a hard time really finding that courage, that determination to fight through it and push on the ski. You definitely have that on the brain and it was affecting me because I couldnt do a proper preparation for the Games." However, Guay said hes working on improving his mental ability to deal with injury much like teammate Jan Hudec of Calgary, who has overcome numerous ailments to succeed on the world scene. "The ideal situation is to not have that pain and I plan to deal with it in the off-season," Guay said. "Right now Im trying to work through it and I think its an important thing. "If I look at a guy like Jan Hudec, probably one of his biggest strengths is that strength and character he shows when he has those injuries. I know he skiis in a lot of pain so I like to watch those circumstances and try to emulate them. Its not always easy for me. I think when I dont feel 100 per cent its tough for me to go out and attack it but id like to think its getting better." LOS ANGELES -- A few minutes after John Gibson finished his NHL playoff debut by shutting out a vaunted post-season power, the Anaheim Ducks rookie goalie barely seemed to register a pulse, let alone any visible excitement.
